808 Time Tracker App

This Acceptable Use Policy (“AUP”) governs your conduct when accessing or using the 808 Time Tracker App and related services (the “Service”) provided by 808 Talent Source, LLC, a Florida limited liability company operating under Impctrsmgmt Group (“808 Talent Source,” “we,” “us,” or “our”).

This AUP is incorporated into and forms part of our Terms of Service. By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP is a material breach of the Terms of Service and may result in immediate suspension or termination of your Account, forfeiture of disputed time entries, legal action, or reporting to law enforcement.

This AUP applies to all users of the Service, including Outsourced Team Members (OTMs), Clients, and Administrators (collectively, “Users” or “you”).

1. CORE PRINCIPLES

The Service exists to accurately record work hours, facilitate fair compensation, and support trusted working relationships between OTMs, Clients, and 808 Talent Source. Every use of the Service must reflect three principles:

Honesty. Every time entry, approval, rejection, and communication must be truthful and made in good faith.

Integrity. Every User must use the Service only for its intended business purpose, without manipulation or circumvention.

Accountability. Every User is responsible for activity conducted through their Account and for promptly addressing errors, disputes, or concerns.

All other rules in this AUP flow from these three principles.

2. PROHIBITED CONDUCT

You may not, and you may not permit any other person to, engage in any of the following:

2.1 Time Entry Fraud and Manipulation

Logging time for work that was not actually performed

Inflating, padding, or exaggerating the duration of work performed

Logging time for personal activities, breaks, idle time, or unrelated work

Logging time for another person or allowing another person to log time for you

Submitting duplicate entries for the same work

Backdating or post-dating time entries to misrepresent when work was performed

Using automated tools, scripts, macros, or mouse-movement simulators to fake activity or time

Falsifying, altering, or misrepresenting task descriptions or work product references

Logging hours that exceed the hours actually worked for the assigned Client or Engagement

Logging hours across multiple Clients simultaneously for the same actual work period

2.2 Approval and Rejection Misuse

Approving time entries you have not reviewed in good faith

Rejecting time entries arbitrarily, retaliatorily, or without a good-faith basis

Rejecting time entries to avoid payment for work that was actually performed

Pressuring an OTM to withdraw, reduce, or alter legitimate time entries

Pressuring a Client to approve time entries that were not actually worked

Using the approval or rejection mechanism for retaliation, harassment, or coercion

2.3 Account and Access Violations

Sharing, selling, or transferring your Account credentials to any other person

Allowing an unauthorized person to log in to, use, or monitor your Account

Accessing the Service using credentials that do not belong to you

Creating duplicate, fake, or unauthorized Accounts

Continuing to access the Service after your authorization has been revoked or your Engagement has ended

Impersonating another User, a 808 Talent Source employee, or any other person or entity

2.4 Security Violations

Attempting to gain unauthorized access to the Service, other Accounts, or underlying systems

Probing, scanning, or testing the vulnerability of the Service without prior written authorization

Circumventing, disabling, or interfering with authentication, rate limiting, logging, or other security features

Introducing viruses, malware, ransomware, trojans, worms, or other harmful code

Conducting denial-of-service attacks or any activity that overloads or impairs the Service

Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Service

Using the Service to attack, exploit, or compromise any other system or network

2.5 Data and Confidentiality Violations

Accessing, copying, exporting, or extracting data you are not authorized to view

Disclosing time records, OTM information, Client information, or other confidential data to unauthorized third parties

Using data obtained through the Service for any purpose other than your authorized use

Soliciting OTMs or Clients outside of the 808 Talent Source platform using data obtained through the Service

Scraping, harvesting, or systematically collecting data from the Service

Retaining, copying, or storing confidential data after your access has ended

2.6 Interference with Other Users

Harassing, threatening, intimidating, or discriminating against any other User through the Service

Posting or transmitting content that is abusive, defamatory, obscene, discriminatory, or hateful

Engaging in conduct that creates a hostile or unprofessional environment for other Users

Interfering with another User's ability to access or use the Service

2.7 Unlawful or Unethical Use

Using the Service for any purpose that violates applicable local, state, federal, or international law

Using the Service to commit fraud, money laundering, tax evasion, wage theft, or other financial crimes

Using the Service in violation of applicable labor, employment, or wage-and-hour laws

Using the Service to facilitate human trafficking, forced labor, or child labor

Using the Service in violation of applicable export control, sanctions, or trade laws

Using the Service to infringe the intellectual property rights of any person or entity

2.8 Competitive and Commercial Misuse

Using the Service to develop, train, or benchmark a competing product or service

Reselling, sublicensing, or commercially redistributing access to the Service without prior written consent

Using the Service to solicit business from other Users for the benefit of a competing staffing, outsourcing, or placement service

3. TRUST AND INTEGRITY STANDARDS

3.1 Accurate Time Reporting

OTMs must log time contemporaneously with the work performed whenever practicable. Where contemporaneous entry is not possible, time must be logged as soon as reasonably possible thereafter, and manual entries must reflect actual work performed. Rounding practices, if any, must be disclosed and applied consistently in accordance with 808 Talent Source policies.

3.2 Task Descriptions

Task descriptions must be specific, truthful, and sufficient to allow a Client or Administrator to understand what work was performed. Vague, generic, or misleading descriptions may be grounds for rejection of time entries and additional review.

3.3 Good-Faith Review

Clients must review submitted time entries diligently and in good faith. Approval signifies that the Client has reviewed the entry and accepts it as an accurate representation of work performed. Rejection must be accompanied by a specific, good-faith reason.

3.4 Dispute Resolution

Disputes regarding time entries must be raised promptly through the Service or with an Administrator. Users must cooperate in good faith with dispute investigations and provide supporting documentation when requested. Self-help remedies, such as unilateral downward adjustments or retaliatory rejections, are prohibited.

3.5 Device and Environment

Users are responsible for using trusted devices and secure networks to access the Service. Logging in from shared, public, or untrusted devices, or over unsecured networks, increases the risk of unauthorized access and is strongly discouraged.

4. MONITORING, AUDIT, AND INVESTIGATION

4.1 Right to Monitor

808 Talent Source reserves the right, but has no obligation, to monitor use of the Service to ensure compliance with this AUP, the Terms of Service, and applicable law. Monitoring is limited to activity within the Service itself, consistent with our Privacy Policy.

4.2 Audit of Time Entries

Time entries are subject to review and audit by Administrators, Clients, and, where applicable, third-party auditors. Users agree to cooperate with audits and to provide reasonable information or documentation when requested. Refusal to cooperate with an audit is itself a violation of this AUP.

4.3 Investigations

If we reasonably suspect that a User has violated this AUP, we may investigate the conduct, which may include reviewing time entries, audit logs, communications, and related records. During an investigation, we may suspend the User's access to the Service on a precautionary basis. Where appropriate, we will share findings with the affected Client, OTM, or law enforcement.

4.4 Preservation Obligations

Users must not delete, alter, or obstruct access to records that are the subject of a pending dispute, audit, or investigation. Preservation obligations continue until the matter is resolved or until we notify the User in writing that preservation is no longer required.

5. REPORTING VIOLATIONS

If you become aware of any actual or suspected violation of this AUP, including suspected time entry fraud, unauthorized access, or misuse of the Service, you must report it immediately.

Reports should include a clear description of the conduct, the identities of the Users involved (if known), the date and time of the conduct, and any supporting evidence. We take reports seriously and will investigate in good faith. We do not tolerate retaliation against any User who reports a suspected violation in good faith. Intentionally false reports, however, are themselves a violation of this AUP.

6. ENFORCEMENT AND CONSEQUENCES

Violations of this AUP may result in one or more of the following consequences, determined at our sole discretion based on the nature, severity, and frequency of the violation:

6.1 Warnings and Corrective Action

Written warning and required acknowledgment

Required correction of affected time entries

Required completion of additional training or onboarding

6.2 Access Restrictions

Temporary suspension of Account access pending investigation

Permanent termination of Account access

Revocation of administrative or elevated permissions

6.3 Financial Consequences

Adjustment, reversal, or forfeiture of disputed time entries

Chargeback of amounts paid based on fraudulent time entries

Recovery of costs and losses caused by the violation, including investigation costs

6.4 Engagement and Relationship Consequences

Termination of the affected Engagement

Termination of the contractor or client relationship with 808 Talent Source

Disqualification from future placements or engagements

6.5 Legal and Regulatory Consequences

Referral to law enforcement or regulatory authorities

Civil legal action to recover damages, costs, and attorneys' fees

Cooperation with subpoenas, court orders, and government investigations

The consequences listed above are cumulative and not exclusive. We may pursue any combination of remedies and are not required to follow a progressive discipline sequence for serious violations.

6.6 Immediate Termination Offenses

The following violations generally warrant immediate termination without prior warning:

Deliberate time entry fraud

Unauthorized access to the Service or another User's Account

Theft, misappropriation, or unauthorized disclosure of confidential data

Violence, threats, or harassment directed at another User

Commission of a crime through the Service

7. CHANGES TO THIS POLICY

We may update this AUP from time to time to reflect changes in our Service, legal obligations, or operational practices. Material changes will be communicated by updating the “Last Updated” date above and, where appropriate, by email or in-App notice. Continued use of the Service after the effective date of an updated AUP constitutes acceptance of the changes.

8. RELATIONSHIP TO OTHER AGREEMENTS

This AUP supplements, and does not replace, the Terms of Service, the Privacy Policy, any Client Services Agreement, any contractor or OTM engagement agreement, and any other applicable agreement with 808 Talent Source. In the event of a conflict between this AUP and another agreement with respect to acceptable conduct on the Service, the stricter standard will apply.
